Re: Topic 1 DQ 2
According to an article published in 2019, health care regulation is an essential and clear framework within which healthcare professionals acquire and maintain the competence needed to provide health services at a high quality (Kreutzberg et al., 2019). It is essentially laws or bylaws that define the overall conditions for which healthcare professionals must meet in regards to educational requirements, title protection, entry to practice, scope-of-practice, and continuing professional development. Each country has the ability to decide whether or not to regulate a specific profession or not and it is based solely on the complexity of the professional’s role and how it affects patient safety. For those of us affected by healthcare regulation, it can be overwhelming to navigate regulations because of the network of bodies that are overseeing the regulations. For example, a potential physician must attend an accredited medical school, take an examination that is nationally administered, obtain a licensure from a state medical board, complete a residency that is governed and funded by a Medicare program, achieve a specialty certification from a private board, and obtain privileges to practice as a hospital that is either publicly or privately operated (Field, 2008). There are various costs and obligations that a provider must keep up with have left them drowning to comply and. Have ultimately left less time for their professional obligations such as treating patients.

Sample Answer 2 for NUR 621 Describe health care regulation in your own words
From my personal experience, health care regulation is an attempt at balancing the health care needs of a population with the costs of providing such care. I have held multiple positions in bedside nursing, as well as utilization review management for a major insurance company over the last five years. This has provided me with very different perspectives on health care, the costs associated, who stands to profit, and impact on the quality of care provided.
During the COVID-19 pandemic, there were multiple emergency resources provided by the government to ensure patients were cared for and facilities were being reimbursed. However, it seems as though some providers were taking advantage of these emergency resources by claiming need for reimbursement under the COVID provisions, even when patients weren’t infected with the virus. When there are loopholes for insurance companies or for providers, the patients are the ones who suffer.
If a hospital provides unnecessary surgery, or bills for uncovered procedures, the insurance company will protect its own assets and deny the claim. This leaves many patients having to cover the difference of extremely costly services that were accepted in good faith. Costs related to health care regulation include doctors’ visits, copays, emergency treatments, post acute therapy, and prescription medications. Pharmaceutical companies have been price gouging for years, charging astronomical amounts for life-saving medications. Only recently, philanthropic billionaires like Mark Cuban have sought to eliminate the power that pharmaceutical companies have over the drug market. By creating his own private pharmaceutical company, he has eliminated the mark-up competition. At a 15% fixed mark-up and a $3 flat fee, it is said that Medicare could have saved almost $4 billion in 2020 alone by purchasing generic drugs through his company (Lovelace, 2022). Overall, health care regulation has a long way to go when it comes to providing quality, cost-effective care that is beneficial for all consumers and the providers who treat them.
